Let's start with the fact that if you want to run a contest on Facebook or Instagram, you should read the rules of the services. And they clearly state what the organizer is allowed to do and what not .
In the case of Facebook, such provisions can be found in the section of the portal's official regulations "Promotions on pages, groups and events" , and in the case of Instagram - "Promotion guidelines" .
Both Facebook and Instagram state in their regulations that the organiser of the competition or lottery, as the promotion administrator:
runs the competition at its own risk and must include in the content regarding the competition a full release of the website from liability by each participant and a statement that such promotion is in no way sponsored, poland rcs data endorsed or conducted by the website, or associated with it;
is responsible for the lawful administration of the competition and information about it. This includes: the official rules, the competition terms and conditions that allow you to participate in it (e.g. age or territorial restrictions), regulations and conditions relating to the prizes offered (e.g. mandatory permits or necessary registration of promotional activities.
additionally, in the case of Facebook, you can run a competition on a page, in a group, in an event or in an application on the portal, but not on a private timeline or using connections with friends (it is therefore forbidden to use slogans such as: "to take part in the competition, you must share a post on your wall/a friend's wall" and "to take part in the competition, you must tag friends in the post");
additionally, in the case of Instagram, it cannot falsely tag content or encourage users of the portal to tag content falsely (it is therefore forbidden to use slogans such as: "to take part in the competition, you must tag yourself in the photo" - even though that person is not in the photo).
